Terms of Service

These Terms of Service ("Terms") govern your access to and use of SudoHire ("Platform"), operated by SudoHire ("Company", "we", "our"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, you may not use the Platform.
1. Eligibility
You must be at least 18 years old to use the Platform. By registering, you confirm that you are 18 or older. Employers must be acting on behalf of a legitimately incorporated company. We reserve the right to verify eligibility and to suspend accounts that do not meet these requirements.
2. Accounts
- You are responsible for maintaining the confidentiality of your login credentials.
- You must provide accurate, current, and complete information at registration and keep it updated.
- You may not create accounts for others without their consent, impersonate any person, or misrepresent your identity or affiliation.
- You may not share your account or credentials with any other person.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Candidate obligations
As a Candidate, you agree that:
- All information in your profile — work history, skills, qualifications — is accurate and truthful.
- You own or have the right to submit all content you upload (including resume files).
- You will not submit false credentials, fabricated experience, or misrepresentations of any kind.
- You understand that employers may contact you after a credit unlock, and you consent to this as part of the sourcing purpose.
- You will respond to interview invitations in good faith. Repeatedly accepting and ghosting interviews may affect your standing on the Platform.
- You will not use the Platform to harvest employer contact information or to solicit business.
4. Employer obligations
As an Employer, you agree that:
- You represent a legitimate, legally incorporated company. Access to Candidate PII requires company verification.
- You will use Candidate personal data only for the recruitment purpose for which it was shared, and in compliance with DPDP 2025 and all applicable law.
- You will not share, resell, or misuse Candidate data accessed through the Platform.
- You will provide timely, constructive feedback to Candidates you reject (as required by the Platform's rejection flow). Persistent ghosting or bad-faith behaviour will affect your Employer Reliability Score (ERS) and may result in suspension.
- You will honour interview commitments you have confirmed. You may reschedule with reasonable notice.
- All job postings must represent genuine, open roles. Fake postings are prohibited.
- You will not use the Platform for any form of discrimination prohibited under applicable Indian law.
5. Credits and payments
- Credits are purchased in advance and consumed when you unlock a Candidate profile or send a stealth ping.
- Credits are non-refundable except where required by applicable law or at our sole discretion in the event of a Platform error.
- Subscription fees are charged in advance on a monthly or annual cycle. Downgrade or cancellation takes effect at the end of the current billing period.
- We reserve the right to change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.
- You are responsible for all applicable taxes on payments made to us.
6. Prohibited conduct
You must not:
- Scrape, crawl, or extract Platform data by automated means without our written consent.
- Attempt to circumvent any security, rate-limiting, or access control measure.
- Upload malware, spam, or harmful content of any kind.
- Use the Platform to harass, threaten, or discriminate against any person.
- Attempt to reverse-engineer the Platform or access data belonging to other users.
- Use the Platform in a way that violates any applicable law or regulation.
Violations may result in immediate account suspension and, where applicable, referral to law enforcement.
7. Intellectual property
The Platform, its design, software, and all content we create are owned by or licensed to SudoHire. You retain ownership of content you submit (your profile, resume, job postings) and grant us a non-exclusive, worldwide licence to display, process, and transmit that content as necessary to operate the Platform. This licence ends when you delete your account or the relevant content.
8. Employer Reliability Score (ERS)
Employers are assigned an ERS based on their conduct on the Platform — including interview attendance, rejection feedback quality, and other signals. The ERS affects search ranking and platform visibility. Employers may appeal ERS deductions through the in-platform appeals process. The Company's decision on appeals is final, subject to the grievance process below.
9. Disclaimers
The Platform is provided "as is" and "as available". We do not guarantee that the Platform will be uninterrupted, error-free, or that search results will lead to successful hires. We are not a party to any employment relationship formed through the Platform. Hiring decisions are solely the Employer's responsibility.
We do not verify the accuracy of all information Candidates provide. Employers are responsible for conducting their own due diligence before making hiring decisions.
10. Limitation of liability
To the maximum extent permitted by applicable law, SudoHire shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of or inability to use the Platform, including loss of profits, data, or business opportunity. Our total aggregate liability to you for any claim arising out of these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
11. Termination
Either party may terminate their account at any time. We may suspend or terminate your account immediately for material breach of these Terms. On termination, your right to use the Platform ceases; unused credits are forfeited (except where required by law). Provisions that by their nature should survive termination will do so, including Sections 6, 7, 10, 12, and 13.
12. Governing law and dispute resolution
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
Before initiating any legal proceedings, you agree to attempt to resolve the dispute informally by contacting our Grievance Officer. We will endeavour to resolve complaints within the period required by DPDP 2025.
13. Changes to these Terms
We may revise these Terms from time to time. We will provide at least 14 days' notice of material changes by email or in-platform notification. Continued use of the Platform after the effective date of a revision constitutes acceptance of the revised Terms.
